Terms of Use

1. About these Terms

These Terms of Use govern your creation of a Listto account and your access to and use of Listto's websites, applications, account features and related services. By completing the required clickwrap during account creation, you agree to these Terms and the Community Guidelines. If you do not agree, do not create or use an account.

The Community Guidelines form part of this agreement and set the conduct standards for Listto. The Privacy Policy explains how personal information is handled, the Signup Collection Notice gives information at collection, and the Copyright and Content Reporting Policy explains complaint processes. The privacy documents and Copyright Policy are presented as notices, not described as consent.

2. Who provides Listto

Listto is provided by Vinicius Martins Delgado trading as Listto, ABN 68 820 965 824, Sunshine West, Victoria 3020, Australia. In these Terms, 'Listto', 'we', 'us' and 'our' refer to that business, while 'you' and 'your' refer to the person using the service.

For support, legal notices, privacy requests, copyright reports, safety reports and account-closure requests, contact admin@listto.com.au. Please include enough information for us to identify the relevant account, content or issue, but never send your password, verification code or recovery code.

3. Eligibility and legal capacity

You must be at least 16 years old to create or continue using a Listto account. Before signup, Listto asks for your date of birth only to determine whether you meet that threshold. The submitted date is processed for that check and is not retained; Listto stores only the eligibility result, rule version, method and evaluation time.

You must also have the legal capacity to enter this agreement and be permitted to use Listto under applicable law. Listto may update its eligibility requirements when reasonably necessary to comply with applicable law or protect users. If Listto cannot confirm eligibility, it may refuse account creation or access.

4. Creating and protecting an account

Provide accurate, current information and keep it reasonably up to date. Accounts are intended for one person unless Listto expressly offers another account type. Your Full name is a public, non-unique account name shown beside your username and can be edited through Profile.

You must choose a public username shown as @username. A username is globally unique and remains permanently reserved once claimed, including after account deletion or correction. Users cannot change usernames themselves. Authorised Listto personnel may correct a username after appropriately verifying the request, and the previous username remains reserved.

For Google or Facebook signup, Listto uses the name supplied through the provider's protected authentication response and lets you choose a username before the account is created. Provider email matches do not automatically merge accounts.

Choose a strong password where one is used and protect your password, linked providers, email verification access, recovery codes and devices. Tell us promptly at admin@listto.com.au if you suspect unauthorised access. Listto will never ask you through ordinary support to disclose a password, one-time verification code or recovery code.

5. What Listto provides

Listto provides tools for discovering, creating, organising and sharing recipes. Depending on availability, these can include pantry tracking, shopping lists, favourites, reviews, public or private recipe sharing, shared-list collaboration, video-to-recipe conversion, nutrition estimates and AI-assisted features.

Features may vary by location, device and availability, and some features may change or become unavailable. If Listto introduces a paid feature or another material commercial arrangement, its price and any additional terms will be presented before you choose to use it.

6. Public and private information

Your Display Name, @username, public recipes and public reviews can be seen by other people. Listto may show @username beside a Display Name in recipes, reviews, invitations, sharing controls and search results to distinguish users. A recipe marked private, pantry information and private shopping lists are intended to remain private except where you deliberately use a sharing or collaboration control.

Listto will not make content public merely because the service-operation licence in section 8 exists. Public visibility occurs only through the relevant publish, visibility or sharing setting that you control, subject to moderation and technical operation. Take care before publishing because people may view, copy or share public material outside Listto, and Listto cannot control independent copies made by others.

7. Ownership of user content

You retain the copyright and other rights you lawfully hold in recipes, written descriptions, photographs, reviews and other material you submit. Uploading or creating content through Listto does not transfer ownership to Listto. If content includes material belonging to someone else, their rights are not reduced by your submission.

Copyright, trade mark, privacy, publicity and moral rights continue to apply according to law. Nothing in these Terms asks an author to give up moral rights. Where technical changes are needed to display content, Listto will seek to preserve attribution and integrity as reasonably practicable, consistent with your instructions, service operation and lawful moderation.

8. Licence needed to operate Listto

You grant Listto a non-exclusive, worldwide and royalty-free licence to host, store, back up, reproduce for technical operation, format, resize, transmit and display your content only as reasonably necessary to provide, secure, maintain and support Listto according to your selected visibility and sharing settings. You may continue using and licensing your content elsewhere.

Listto may sublicense these limited functions only to contracted hosting, storage, delivery, security and other service providers performing them for Listto. This licence does not permit Listto to sell your content, use it for unrelated advertising, or use it to train general AI models without separate, express permission. Private content must remain private under the relevant settings. The licence ends when the content no longer needs to be retained, except as section 9 or law requires.

9. Permanent account deletion and retained content

Listto provides a self-service account-deletion control in Account Security. To protect against unauthorised deletion, Listto requires appropriate security verification before acting on a request. Deletion takes effect when the required checks succeed, is intended to be irreversible, and does not include a promise that support can restore the account.

Deletion permanently disables the account and its sign-in methods. A later account using a released email address or provider identity is a separate account and does not regain the deleted account, its ownership, history or private content. The deleted account's username remains permanently reserved, while its historical Display Name may be used by another account because Display Names are not unique.

Public recipes that remain at deletion stay publicly available under the neutral author label 'Anonymous'. Listto retains a limited protected connection to the deleted account only where reasonably needed for legal, safety, moderation, security and ownership purposes. That information is not visible to ordinary users. The limited licence in section 8 survives only as needed to store, display, secure, moderate and maintain those retained recipes.

Published reviews remain visible with the historical Display Name and a deleted-account indication so the review keeps its community context. The retained name has no active username or profile link and cannot be used to sign in. Private recipes, pantry records, private shopping lists and other non-public content remain non-public and inaccessible through the deleted account. Listto may retain limited account, content, legal, security, complaint and moderation information where reasonably needed for legal compliance, dispute handling, safety, fraud prevention, service integrity and controlled backups.

Deletion does not make private content public and does not transfer ownership to a later account. Technical backups may take time to expire under controlled retention schedules, and legal holds or unresolved complaints may require limited retention for longer. Before deleting the account, remove public content you do not want retained and save any information you need; the ordinary deleted account cannot recover it afterward.

10. Responsibility for submitted content

Submit material only when you created it, own the necessary rights, have permission, or have another lawful basis to use it in the way you select. You are responsible for considering copyright, confidentiality, privacy, trade marks, contractual restrictions and other rights before uploading or publishing.

Do not submit confidential information belonging to another person or organisation without authority. Naming a creator or adding a source link is good practice where appropriate, but attribution alone does not create permission. If a credible concern arises, Listto may ask for reasonable evidence of ownership, authority, consent or licence and may restrict the content while the issue is assessed.

11. Recipes based on third-party videos or sources

Listto may support recipe creation from YouTube, TikTok, Facebook and other external videos, pages or sources. Providing a link, generating a draft, extracting factual information or displaying source attribution does not transfer ownership of the source material or give you permission to reproduce protected expression, images, audio or video.

You remain responsible for lawful use and for following applicable source-platform terms. Listto may preserve source attribution or provenance links, restrict removal or editing of those links, decline a conversion, limit publication, or remove generated material where rights, safety, source accuracy or platform compliance is uncertain. A conversion tool is not a legal clearance service and does not guarantee that publication is permitted.

12. AI-generated and estimated information

AI-assisted output may be incomplete, incorrect, inconsistent, similar to existing material or unsuitable for publication. Generated recipes can omit context, misunderstand a source, invent measurements or provide unsafe suggestions. You must review and, where necessary, correct every generated result before saving, publishing, cooking or sharing it.

Nutrition values and similar calculations are estimates, not laboratory analysis or professional advice. Contracted AI or processing providers may process the inputs necessary to provide a feature you request, as described in the Privacy Policy. The limited licence in section 8 allows requested service processing but does not authorise Listto or its providers to use user content for general model training without separate, express permission.

13. Food, allergy and health safety

Recipes and community content may contain mistakes or may not suit your circumstances. Independently check ingredients, allergens, cross-contamination risks, substitutions, storage conditions, expiry, preparation methods, cooking temperatures, serving sizes and dietary suitability. Product formulations and official safety guidance can change.

Listto is not medical, dietary, nutritional or professional food-safety advice. Seek advice from a qualified health professional, accredited practising dietitian, allergist or relevant food-safety authority when health conditions, pregnancy, children, severe allergies or other material risks are involved. Nothing in this section excludes a guarantee, remedy or responsibility that cannot lawfully be excluded under Australian law.

14. Community conduct and acceptable use

You must follow the Community Guidelines. Do not harass, threaten, bully, impersonate or discriminate against others; invade privacy; submit unlawful or exploitative material; promote dangerous deception; commit fraud; distribute spam; manipulate engagement; or deliberately misrepresent identity, authority or experience.

Do not use malicious automation, credential attacks, malware or abusive bots; scrape private information; probe accounts without authority; bypass rate limits, access controls or verification; interfere with reporting, moderation or security controls; overload the service; or help another person do those things. Lawful security research and statutory rights are addressed in section 18, but good-faith activity does not include accessing other users' data or creating avoidable harm.

15. Reviews, collaboration and shared lists

Reviews must be honest, relevant and based on genuine experience. Disclose a material relationship where a review could otherwise mislead. Do not offer or accept manipulation, post fabricated experiences, coordinate harassment or use reviews to expose personal information.

Collaboration features may distinguish owners, invited users, read-only users and people using a public link. Visibility never grants management or editing rights by itself. Use only the permissions provided to you, and do not intentionally corrupt, destroy, conceal or misuse shared recipes, pantry records, shopping lists or activity. Owners remain responsible for choosing collaborators and removing access when it is no longer appropriate.

16. Reports, moderation and enforcement

Listto may respond to violations or credible risks with education or warnings, visibility limits, content removal, feature restrictions, temporary suspension or permanent account closure. We aim to choose action proportionate to the seriousness, likelihood and immediacy of harm, repeated behaviour, available evidence, service integrity and legal requirements.

Credible safety, security or legal emergencies may require immediate action without advance notice. Enforcement may extend to replacement accounts used to evade a restriction. Where practicable, we will explain the general reason without exposing reporters, confidential information, security protections or another person's rights. You may request review by emailing admin@listto.com.au with relevant context, and Listto will consider a clear, good-faith request fairly.

17. Copyright and other complaints

The Copyright and Content Reporting Policy forms the process for reporting copyright, privacy, impersonation, defamation, unsafe content and related concerns. It explains the information a report should contain, possible requests for clarification, temporary restriction, notice to affected users where appropriate, counter-information, restoration and action for repeated infringement.

Copyright permission may be required even when material is easy to access online. Australian copyright owners may retain rights including reproduction, publication and communication rights, and creators may retain moral rights. Listto may preserve evidence and restrict disputed content while assessing a report, but cannot finally decide complex ownership disputes between parties. Knowingly false or misleading reports are prohibited.

18. Listto intellectual property

Listto's name, branding, software, interface design, databases, documentation and original materials are owned by or licensed to Listto. Subject to these Terms, Listto gives you a limited, revocable, non-exclusive and non-transferable right to access and use the service through its normal interfaces for lawful personal, creator or small-business purposes.

You must not falsely claim affiliation, copy Listto branding in a confusing way, sell access, reverse engineer or interfere with the service except where law allows. Nothing in these Terms restricts statutory rights that cannot be excluded, including lawful interoperability, accessibility, competition, consumer-protection or good-faith security research rights. Researchers should minimise harm and report vulnerabilities privately to admin@listto.com.au before public disclosure where reasonably possible.

19. Third-party services and links

Listto may link to or interact with external websites, videos, email delivery services, AI providers and other third-party systems. Those services have their own terms, privacy practices, moderation decisions, technical limits and availability. Review applicable third-party rules before using a connected feature.

A link, embed or technical connection does not mean Listto endorses or guarantees third-party content, products, people or conduct. To the extent permitted by law, Listto is not responsible for independent third-party acts, outages or content outside Listto's reasonable control. This does not reduce any responsibility Listto has under mandatory law for its own representations, choices or supply of the Listto service.

20. Service and security communications

Listto may send communications reasonably necessary to create, operate and protect your account, including verification and login messages, recovery and security alerts, legal notices, complaint updates and important operational information. These are service communications rather than promotional subscriptions.

Creating an account does not subscribe you to promotional email. New accounts begin with marketing email turned off. Any future promotional email choice is separate and may be withdrawn through the available unsubscribe or account-preference controls. Keep an accessible email address on the account so essential service, security and legal messages can reach you.

21. Availability and changes to the service

Listto does not promise that every feature will always be available, uninterrupted or error-free. Maintenance, third-party availability, security or safety needs and legal requirements may affect access. We will take reasonable care in operating the service, subject to applicable consumer guarantees.

We may make reasonable changes to improve performance, accessibility, safety, security or usefulness, or to retire features that are no longer supportable. Where a foreseeable change materially reduces an important account feature, we will give reasonable notice when practicable. Urgent security, safety or legal action may occur without advance notice, and we will explain material effects afterward where appropriate and lawful.

22. Suspension and ending the agreement

You may stop using Listto at any time and may permanently delete your account through Account Security after completing the required ownership and fresh-email-verification checks. Section 9 explains the effect of deletion and retained content. If you do not accept a future mandatory agreement, you may remain signed out and delete or request closure of the account through the available process.

Listto may restrict, suspend or close an account for a serious or repeated breach of these Terms or the Community Guidelines, a credible security or safety risk, fraud, infringement, evasion of enforcement, or a legal requirement. Where appropriate and lawful, Listto will explain the general reason and available review contact. Urgent action may occur without advance notice.

When the agreement ends, provisions that reasonably need to continue may survive, including ownership, the narrow retained-content licence in section 9, confidentiality and security protections, complaint and enforcement evidence, Australian Consumer Law rights, liability rules and dispute provisions. Survival does not create a broader right to use deleted private content.

23. Australian Consumer Law, warranties and liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law. If Listto supplies services to you as a consumer, you may have statutory remedies when those services fail to meet an applicable guarantee.

To the maximum extent the law permits, Listto is not responsible for losses that were not reasonably foreseeable, independent third-party conduct, or user content and deliberate misuse beyond Listto's reasonable control. These limitations do not apply where Listto caused the loss through conduct for which liability cannot be excluded. These Terms do not impose a broad consumer indemnity. You remain responsible, subject to applicable law, for loss caused by your unlawful content, fraud, intentional security attack or deliberate misuse.

24. Changes to these Terms

Each version of these Terms has an effective date. For a material contractual change, Listto will give at least 30 days' notice where reasonably practicable and require renewed acceptance before the changed Terms govern continued account use. Previous versions remain available as part of the account's legal history.

Shorter notice may be necessary to comply with law or respond to urgent security or safety risks. Where that happens, we will explain the reason and effect when lawful and practicable. If you do not accept a material change, you may stop using Listto and request account deletion before the new Terms apply to continued use.

25. Complaints, disputes and governing law

Please contact admin@listto.com.au first with a clear description, relevant dates, URLs and the outcome you seek so Listto can investigate and try to resolve the issue. We may ask for identity, authority or account-ownership verification before disclosing protected information or changing an account.

These Terms do not prevent you from contacting a regulator, consumer agency, law-enforcement body or court. There is no forced arbitration clause, class-action waiver or foreign exclusive forum. Victorian law governs this agreement, subject to the Australian Consumer Law and any mandatory law or jurisdictional right that applies to you. Courts with lawful jurisdiction may hear a dispute.

26. General legal provisions

If a provision is unlawful or unenforceable, it will be read down to the minimum extent necessary or severed, and the remaining provisions continue. A delay in enforcing a right is not a waiver. Notices may be given electronically to the account email or through a clear service notice where law permits.

Listto will not assign this agreement in a way that materially reduces your rights without appropriate notice and any consent required by law. These Terms, together with the incorporated Community Guidelines and the policies expressly referenced for relevant processes, form the account agreement. The Key points summary and plain-language headings help navigation but do not override the contractual clauses.
